Technique creates piezoelectric ferroelectric nanostructures

ScienceDaily (Feb. 21, 2012) ? Researchers have developed a "soft template infiltration" technique for fabricating free-standing piezoelectrically active ferroelectric nanotubes and other nanostructures from PZT -- a material that is attractive because of its large piezoelectric response. Developed at the Georgia Institute of Technology, the technique allows fabrication of ferroelectric nanostructures with user-defined shapes, location and pattern variation across the same substrate.

The resulting structures, which are 100 to 200 nanometers in outer diameter with thickness ranging from 5 to 25 nanometers, show a piezoelectric response comparable to that of PZT thin films of much larger dimensions. The technique could ultimately lead to production of actively-tunable photonic and phononic crystals, terahertz emitters, energy harvesters, micromotors, micropumps and nanoelectromechanical sensors, actuators and transducers -- all made from the PZT material.

Using a novel characterization technique developed at Oak Ridge National Laboratory, the researchers for the first time made high-accuracy in-situ measurements of the nanoscale piezoelectric properties of the structures.

"We are using a new nano-manufacturing method for creating three-dimensional nanostructures with high aspect ratios in ferroelectric materials that have attractive piezoelectric properties," said Nazanin Bassiri-Gharb, an assistant professor in Georgia Tech's Woodruff School of Mechanical Engineering. "We also leveraged a new characterization method available through Oak Ridge to study the piezoelectric response of these nanostructures on the substrate where they were produced."

The research was published online on Jan. 26, 2012, and is scheduled for publication in the print edition (Vol. 24, Issue 9) of the journal Advanced Materials. The research was supported by Georgia Tech new faculty startup funds.

Ferroelectric materials at the nanometer scale are promising for a wide range of applications, but processing them into useful devices has proven challenging -- despite success at producing such devices at the micrometer scale. Top-down manufacturing techniques, such as focused ion beam milling, allow accurate definition of devices at the nanometer scale, but the process can induce surface damage that degrades the ferroelectric and piezoelectric properties that make the material interesting.

Until now, bottom-up fabrication techniques have been unable to produce structures with both high aspect ratios and precise control over location. The technique reported by the Georgia Tech researchers allows production of nanotubes made from PZT (PbZr0.52Ti0.48O3) with aspect ratios of up to 5 to 1.

"This technique gives us a degree of control over the three-dimensional process that we've not had before," said Bassiri-Gharb. "When we did the characterization, we saw a size effect that until now had been observed only in thin films of this material at much larger size scales."

The ferroelectric nanotubes are especially interesting because their properties -- including size, shape, optical responses and dielectric characteristics -- can be controlled by external forces even after they are fabricated.

"These are truly smart materials, which means they respond to external stimuli such as applied electric fields, thermal fields or stress fields," said Bassiri-Gharb. "You can tune them to behave differently. Devices made from these materials could be fine tuned to respond to a different wavelength or to emit at a different wavelength during operation."

For example, the piezoelectric effect could permit fabrication of "nano-muscle" tubes that would act as tiny pumps when an electric field is applied to them. The fields could also be used to tune the properties of photonic crystals, or to create structures whose size can be altered slightly to absorb electromagnetic energy of different wavelengths.

In fabricating the nanotubes, Bassiri-Gharb and graduate student Ashley Bernal (currently an assistant professor at the Rose-Hulman Institute of Technology) began with a silicon substrate and spin-coated a negative electron-beam resist material onto it. A template was created using electron-beam lithography, and a thin layer of aluminum oxide was added on top of that using atomic layer deposition.

Next, the template was immersed under vacuum into an ultrasound bath containing a chemical precursor solution for PZT. The structures were pyrolyzed at 300 degrees Celsius, then annealed in a two-step heat treating process at 600 and 800 degrees Celsius to crystallize the material and decompose the polymer substrate. The process produced free-standing PZT nanotubes connected by a thin layer of the original aluminum oxide. Increasing the amount of chemical infiltration allows production of solid nanorods or nanowires instead of hollow nanotubes.

Though the researchers used electron beam lithography to create the template on which the structures were grown, in principle, many other chemical, optical or mechanical patterning techniques could be used for create the templates, Bassiri-Gharb noted.

In studies done in collaboration with researchers Sergei Kalinin and Alexander Tselev of the Center for Nanophase Materials Sciences at the Oak Ridge National Laboratory, the devices produced by the soft template process were analyzed with band-excitation piezoresponse force microscopy (BPFM). The technique allowed researchers to isolate properties of the AFM tip from those of the PZT sample, allowing analysis in sufficient detail to detect the size-scale piezoelectric effects.

"One of our most important observations is that these piezoelectric nanomaterials allow us to generate a factor of four to six increase in the extrinsic piezoelectric response compared to the use of thin films," said Baassiri-Gharb. "This would be a huge advantage in terms of manufacturing because it means we could get the same response from much smaller structures than we would have had to otherwise use."

Samsung Mobile Display was set up as a partnership between Samsung and Samsung SDI in 2009, and is the company behind Samsung's OLED displays for smartphones and other mobile devices.

The move follows the 750 billion won operating loss (about $668 million) realized by Samsung's LCD business in 2011. Everyone's having a hard time making money selling LCD TVs, but having seen the 55-inch OLED set in person, we would expect that red ink to start drying up if Samsung Display is able to get big screen OLEDs in the market at a reasonable price point.

Fruit Flies Use Alcohol to Self-Medicate, but Feel Bad about it Afterwards

This article is the second (see the first here) in a miniseries of five articles that will be posted over five days about civilization, fungus, and alcohol. The first four articles are already determined, but just how this series finishes up will be determined by the comments and ideas of readers.

Sometimes scientists are asked if they have hobbies. What follows is an awkward pause. It is not as if scientists don?t have hobbies, it is just that their hobbies tend to involve doing exactly the same thing they do at work, just at home. For example, I work in a department filled with fish biologists. Those fish biologists seem to enjoy, as a hobby, fishing, often for the same fish species they study during the day. The emotions a scientist feels for his or her quarry do not just disappear upon heading home.

When the fruit fly biologist Todd Schlenke, now at Emory University, picked up a hobby in graduate school it was catching fruit flies in his backyard. Fly catching is easy. While one might, with some real luck, catch a hundred fish in a day, Todd could catch hundreds of fruit flies in a single jar, sometimes of many different species. It is a good hobby. He genuinely loves it. It is a delight to see all the flies. You never know exactly what you will see. Any jar might hold a rare species or reveal a new behavior. No matter how bad your day is, if you come home to a new species of fly, it is a good day. The down side is fruit flies follow Todd Schlenke wherever he goes1.

One day when checking on his flies Todd saw something odd. It would change his life. A wasp was crawling from one fly larva to the next. It was tiny, delicate and deadly. The wasp, as he would later figure out, was using its needle like ovipositor to inject its eggs inside the larvae of the fruit flies. The wasp eggs then hatch, consume the fly from the inside and, once metamorphosed, break out of their borrowed skin, winged and reborn. Todd became fascinated with the story of the flies and the wasps. It was a kind of war going on everywhere, or at least everywhere within rotten bananas, which in his life were everywhere2.

More species of these wasps, called parasitoids, live on Earth than species of birds or mammals, many more3. Theirs is among the most often repeated dramas, a Shakespearean tragedy playing out on a billion small stages. ?All around you, whether you realize it or not, animals are being born out of the bodies of other animals. Listen carefully and you can almost hear the sound of thoraxes cracking open and fairy-winged wasps being born. Once they?ve mated, these wasps are good mothers, better than average anyway. Like their own mums, they put them where they will have food and protection, inside other animals. To do so, the wasps must find their hosts, fly expertly in order to lay their eggs inside them as they flee and evade, have an egg-needle just the right length and width to put an egg deep enough but not too deep, and elude the host?s immune system with chemicals and other subterfuge so the hosts immune system does not kill her precious children. For these reasons, wasps often lay their eggs in just one or a few host species, those species with which they have evolved, hosts for which their sinister tools of motherhood are honed.

The wasp Todd has come to study is one species of these multitudes, a species engaged it a protracted evolutionary battle with fruit flies, or rather with a specific species of fruit fly, Drosophila melanogaster. Each generation, the wasp evolves to be better and better at finding flies, sinking its eggs in those flies and having the eggs mature into wasps. Each generation, the fruit flies, in turn, evolve counter responses. It is this evolutionary drama on which Todd has focused much of his professional life, that and booze.

Todd studies these wasps and flies out of raw fascination. They are at war. If the fly wants anything, it is to survive and mate. The wasp wants the same. Their goals at are at odds. But, like most of the many thousands of people who study fruit flies, he also sees their bodies as miniature versions of our own bodies. The flies are toy soldiers with which he can reenact particular battles again and again and understand the circumstances that lead the one or the other side to lose. He gets to revisit the history of wasps and flies, but, in doing so, he also hopes to understand the story of humans and the species living in our bodies, if not wasps then bacteria, viruses, worms, and more. In this context, Todd began to wonder whether the flies could do more than use their immune systems to fight their wars with the wasps. He wondered if flies used, however accidentally, alcohol as a kind of weapon. He wondered if they could drink themselves to life and, a bit more remotely, he could not help but wonder if we could too.

Todd envisioned a contest between two individuals (the fly and the wasp), in which the one who is least affected by alcohol wins. Todd thought the flies might be able to hold their alcohol better than the wasps. His idea was speculative and yet plausible.? Fruit flies feed on all sorts of toxic things, including alcohol, and it was already known that in some cases the flies tolerate more of the toxins than the species that feed on the flies. Species evolve to tolerate the toxins to which they are most frequently exposed, or they suffer, fail to reproduce and, ultimately, go extinct4

Todd?s idea was not the sort of thing his fruit fly colleagues often study, but Todd did not yet have to convince his colleagues that his idea was interesting. He just had to convince excitable young students, which he did. Neil Milan, a graduate student working with Todd and Balint Kacsoh, an ambitious undergrad, decided to test Todd?s idea. They began with simple tests of the kind a high school lab could do. They put flies and wasps in different levels of alcohol to see when they died. It was a little more complex than that, but not much5. Voila! Todd?s predictions held. Fruit flies could deal with the highest concentration of alcohol, followed by the specialist wasps and then the generalist wasp (which was presumably less adapted to dealing with the flies? tricks). When they performed a follow up experiment, things got more interesting. Neil, and Balint went back to the lab and tested whether the wasps tended to lay fewer eggs in the larvae of flies that had been drinking high proof alcohol. It would only make sense for the wasps to avoid toxic flies.? Oh clever wasps, they did.

Voila! Todd?s predictions held. Fruit flies could deal with the highest concentration of alcohol, followed by the specialist wasps and then the generalist wasp (which was presumably less adapted to dealing with the flies? tricks). When they performed a follow up experiment, things got more interesting. Neil, and Balint went back to the lab and tested whether the wasps tended to lay fewer eggs in the larvae of flies that had been drinking high proof alcohol. It would only make sense for the wasps to avoid toxic flies.? They did, these clever wasps.

It was when the students looked at the older flies (and within them the older wasps) that they saw something curious. Flies who had not been drinking alcohol and were then infected could kill their wasps by drinking AFTER being infected by a wasp (In a particularly gruesome way; the alcohol in the flies caused the innards of the wasps to dissolve and spill out their anuses). This simple observation raised the crazy possibility, a possibility only a man who loves flies and marvels at their ingenuity would consider. Perhaps, the flies might be able to use the alcohol as a kind of medicine, to kill the wasps once they were infected. This would require the flies to be able to know when they were infected and to respond by drinking more alcohol when they were, even though high levels of alcohol could make them sick too. It was crazy, but possible but crazy ideas are what give scientists the delighted shivers. Suddenly the two students and Todd found themselves moving further out, shimming a little, onto a speculative limb. From there they reached and then, when there was little left to hold them up, jumped.

Much of what modern scientists do, in studying fruit flies, is akin to a sort of sophisticated flea circus. Flies are made to do things, scientific tricks, which simultaneously amuse scientists and educate them. In each new study, the tricks are made more elaborate. ?Spectators, can this fly jump through the hoop?? becomes ?Spectators can this wingless fly, jump through the flaming hoop?? In the thousands, yes literally thousands, of labs with fruit flies, these tricks are being performed daily, typically set to the theme of whatever music is popular among the students of the time.

The hoop Todd and his students wanted the flies to jump through was the one marked ?use tools to medicate themselves when they are sick.? It was an outlandish hoop, and yet easy to test and so they made the flies jump. In the experiment, some flies were infected by wasps. The others were not. The flies were then allowed to choose where to feed. For Todd and his students this was a nerve-wracking experiment. If the infected flies self-medicated, it would be exciting. It would be a ?yaah, science is great, I can?t believe what wild things can do. OHHHH, I wonder if this applies to humans moment.? But if they did not, well, it would be clear evidence of what flies can?t do which, needless to say, no one actually cares about.

Other species medicate themselves. The flies would not be the first. Some ants gather resin to kill bacteria. Some monkeys eat millipedes. But what was different was that the question of the fly seemed to have to do with humans. Here was more than metaphor. If the flies could drink alcohol to kill their parasites, it would suggest that maybe the same thing might apply to humans. Solomon Katz, an anthropologist at the University of Pennsylvania, had already suggested that perhaps humans had begun to drink alcohol to kill their parasites. Without quite knowing it, Todd was conducting one of the most direct tests of Katz?s hypothesis (see Part 1). Todd waited and tried not to hope, but who are we kidding. He wanted for the flies to choose the booze.

Time passed. Some flies died. Some wasps emerged. Choices were made. And then and only then were the data analyzed and the data revealed that, yes, yes, yes, the flies chose to imbibe more alcohol when they were infected. Not only do flies who drink more alcohol deter their parasitic wasps, they kill them. Not only do they kill them, but when they are infected with wasps, they tend to seek out alcohol, in order to kill them. These flies, who drink for a living, drink more in order to stay parasite free, even if it makes them a little sick. They drink more when parasites are more of a problem. They drink more, in other words, in situations like those encountered by the first settlements of humans, situations in which parasites are common. They drink more when they are infected even though drinking more actually makes them more likely to die from the alcohol too, just less likely than from the wasps. Todd and the students were elated. Their idea held up. The sensation of having an idea bear out is a kind of exalted and lucky grace. It is joyful and fleeting and, did I mention fleeting.

From the perspective of a naturalist, one wonders how many other species self-medicate by drinking alcohol. From the perspective of humanity, one wonders whether the same sort of thing might be going on inside our own bodies. Of course, we do not get infected by wasps who lay their eggs in our flesh only to have those eggs turn into larvae that eat us from the inside out (although see Mark Moffett?s body). Bless their hearts, such is the fate of insect hosts not vertebrates. But, we do suffer from parasites and pathogens. Is it possible we could also drink them to death?

It would not be that hard to repeat versions of Schlenke?s experiments with pathogens of humans. You could not do it in the same way, of course. Even college students object to being put in petri dishes over the weekend, even if they get to drink. But it could be done. Actually, parts of it already had been, by a student named Janet in Inverness, Scotland. Like Schlenke and his students, once she started thinking about the benefits of alcohol, she was addicted. She could not stop.

3- I will speculate, though don?t know, that there are even more species of hyperparasitoids (parasitoids that lay their eggs inside of parasitoids which are, in turn, inside of other hosts), than there are birds or mammals. The world is full of animals living inside other animals.

4-This may well be why pigeons, fish and rats go uneaten even in cities where people are starving. They have both evolved the ability to survive despite consuming high levels of toxins. If we eat them, we have no such resistance. Success, sort of, success always being relative in evolution.

5-Perhaps the one additional detail worth mentioning is that the two students compared the flies tolerance to that of two different species of wasps, one that is a specialist on fruit flies and one that is not. The prediction, at least as it came to them when they were planning the project, was that the wasp that had not evolved to depend on the fruit flies would be less able to deal with their heavy intake of alcohol.

TAIPEI, Taiwan (AP) ? Prosecutors say Taiwanese-Japanese starlet Makiyo has been barred from leaving Taiwan pending an investigation into her alleged involvement in the beating of a taxi driver in Taipei.

The Taipei Prosecutors Office said Tuesday the 27-year-old singer is accused of kicking a taxi door after her companion, who allegedly was drunk, dragged the driver out and beat him.

Makiyo has apologized and pledged to stop drinking after the Thursday night incident.

Prosecutors say Takateru Tomoyori of Japan was released on bail pending formal charges, possibly attempted homicide.

The driver suffered brain bleeding and two broken ribs.

News reports said the taxi driver asked Tomoyori and Makiyo to get out after they refused to wear seat belts.

A few things seem clear about our identities:?One, our identities are multi-faceted and, to an extent, in flux.?Two, our identities are at least partially, if not largely, socially constructed.?This means that they are very seriously related to our reference classes, our organizational and social identities, and to our cultural norms/values.?Three, it seems clear that we only have a partial knowledge of what we consider our ?identities? and that this very concept is partially socially based.?Four, we have very little, if any at all, idea of how our self identity is formed and maintained.?

William James, one of this nation?s greatest intellectual treasures, used psychology to explore these seminal questions.?Psychology, as a methodology, is especially well suited to exploring questions of self-identity. ?Firstly, it is able to quantitatively come up with counterintuitive and unpredicted results through the use of controlled experiments and natural experiments (including cross cultural experiments).???This is especially useful for self-concept analysis which is often counter intuitive by its very nature.?Secondly, it is good at dealing with multi-layered and multi-functional phenomena.?Self-concept analysis seems to be like this.?Thirdly, it is highly focused on verifiable or at least testable results, which is something past philosophical speculation never took seriously and which limited research into self-concept analysis seriously.?Lastly, it has developed as a literature in which OFTEN each paper takes on relatively small chunks of an issue and explores it in depth.?Since such a field, with ?bricks? of knowledge rather than ?edifices? tending to be built, lends itself to a building up of walls of verified and accepted information, self-concept/identity analysis has been able to grow slowly and develop some foundational basic beliefs which are so helpful to so complex a field.

William James?s The Principles of Psychology, chapter X ?The Consciousness of Self? is a masterful attempt to understand who and what our self identity, of who we are and how we view our selves.?It is limited by its cultural relativism (as seen in later works explored in this essay), an ?unscientific,? and more philosophically pensive, approach, and a lack of empirical, quantitative data to explore its propositions.?Nevertheless, it provides a framework to think about the problem and effectively illustrates how hard it is to think about who and what we are.?It astutely points out that we have multiple selves, that there is a salient to these multiple selves, that we have social selves, group selves, and individual selves, that our concept of self is arbitrary and adjusts, and many other ideas later explores more qualitatively and refined in later psychological works.?

Timberwolves' Love suspended two games for flagrant foul (Reuters)

(Reuters) ? Minnesota Timberwolves forward Kevin Love has been suspended for two games for "driving his foot into the upper body and face" of Houston Rockets forward Luis Scola as Scola was lying on the floor, the National Basketball Association said on Monday.

The incident, which was upgraded by the league to a Flagrant Foul Two, occurred during the third quarter of the Timberwolves' 100-91 win over the Rockets in Minneapolis on Saturday.

Scola had been stripped of the ball while attempting a shot and fell to the floor. Love, an NBA All-Star in 2011, stepped on Scola's face while he was heading upcourt.

Love, the Timberwolves' leading scorer and rebounder, will miss games against Sacramento on Tuesday and Memphis on Wednesday. He is averaging 25.0 points and 13.7 rebounds.

Greece pushes for deal with lenders on contested reforms (Reuters)

ATHENS (Reuters) ? Greece's government makes another push on Saturday to hammer out a deal with foreign lenders on a 130 billion euro bailout before turning to the trickier task of convincing wary political leaders to back the additional painful reforms involved.

On the brink of bankruptcy, Athens must wrap up talks with foreign lenders on the bailout and get political approval for it soon to ensure funds begin flowing in time for the country to pay back 14.5 billion euros of bonds falling due in mid-March.

But negotiations with its 'troika' of international lenders have struggled over their demands that it cut labor costs by axing holiday bonuses and lowering the minimum wage - proposals strongly opposed by Greek political party leaders.

After initial hopes that a deal with lenders from the European Union, European Central Bank and the International Monetary Fund could be secured on Friday, marathon negotiations ended early on Saturday with crucial issues still unresolved.

Finance Minister Evangelos Venizelos was due to resume talks with lenders on Saturday in a bid to clinch agreement before technocrat Prime Minister Lucas Papademos calls the socialist, conservative and far-right leaders in his coalition to seek their blessing.

That meeting of party chiefs, initially scheduled for Saturday, has now been put off until Sunday afternoon, a government source said.

Increasingly frustrated with Athens' inability to enact the reforms needed to reshape the recession-hit Greek economy, foreign lenders have demanded proof of the country's commitment to spending cuts before doling out any more funds.

They want all the country's political chiefs - who are keen not to be linked directly with the painful reforms as they gear up for elections expected in April - to back the measures, irrespective of the outcome at the polls.

"Greek political leaders must offer their commitment to the program," said a source close to the lenders.

"No more loans will be approved if they don't."

The Kathimerini newsapaper reported on Saturday that if political leaders did not reach a deal on reforms, Papademos was considering asking them to either authorize a new round of negotiations with the troika or themselves join the discussions.

Ordinary Greeks are seething as round after round of austerity measures is imposed on them as the price for saving the country from default.

Protesters from a leftist group held a demonstration outside the prime minister's office on Saturday, holding up banners against the political parties and the troika.

Athens has repeatedly said the talks on a bond swap with private holders of Greek debt and on the bailout are in their final stage. But it has failed to secure either deal after weeks of wrangling, largely due to concern that the rescue plan will not do enough to cut Greece's debt burden to a manageable level.

European Union sources said on Friday that euro zone governments may now have to cough up an extra 15 billion euros on top of the 130 billion agreed in October because of the funds needed to recapitalize Greece's ailing banks.

Athens also wants public creditors like the European Central Bank to take part in the bond swap deal, under which banks and insurers will take real losses of about 70 percent on the Greek debt they hold.

The bond swap talks were now the easier part of the overall process to save Greece, Venizelos said earlier on Saturday.

Representatives for the banks and insurers are expected to be back in Athens to continue talks over the weekend.

In Nevada, Gingrich fumbles but moves forward

LAS VEGAS (AP) ? Newt Gingrich is struggling to regain his footing following a campaign in Nevada beset by glitches as the race for the Republican presidential nomination moves to the next phase.

During the few days following Tuesday's drubbing in Florida, Gingrich bungled a meeting with Nevada's governor then suffered through the indignity of having advisers tell reporters that the former House speaker would score the endorsement of Donald Trump, only to watch the unpredictable real estate tycoon back Mitt Romney.

Gingrich's campaign has always been a bit of a freewheeling affair, especially lined up against the regimented Romney effort. Gingrich is perpetually late, he frequently strays off message and his schedule sometimes seems improvised. His public appearances in Nevada have been surprisingly few, and he didn't even venture out to caucus sites on Saturday as voters cast ballots.

But in Nevada, organizational problems have been laid bare in a fashion that raises questions about whether he's can compete in upcoming contests.

Gingrich aides say they have been using Nevada ? where Romney was heavily favored and Ron Paul has sizable support ? to reset the campaign after being clobbered in Florida.

One reason Gingrich held just five public events since arriving in Nevada is that he's been at closed-door fundraisers and meeting with donors at the Venetian Hotel, lining up the cash he'll need.

The Gingrich strategy hinges on Super Tuesday on March 6, when the campaign will sweep South again through states that look good for him. Gingrich ? who is own chief strategist ? and aides have been hunkered down mapping out strategy. Ohio will figure prominently in the mix. He'll head to the Super Tuesday state on Wednesday, bypassing other states that have contests sooner.

Gingrich named Patrick Millsaps, a Georgia Republican who had been traveling with Gingrich as his deputy legal counsel, as a chief of staff. Millsaps is tasked with making the trains run on time and also installing day-to-day message discipline on the road.

Nevada provides a pretty good example of what not to do.

"We're a bunch of volunteers that are drinking water through a firehouse," said George Harris, a national co-chairman of Gingrich's finance team who hosted a fundraiser for him at his Las Vegas restaurant, Mundo.

"And yeah, sometimes the left hand doesn't know what the right is doing. But that's how it goes sometimes," Harris said.

In fairness, just three days separated the Florida primary and the Nevada caucuses. Romney carried 51 percent of the vote in the state when he first sought the Republican nomination in 2008, and his Nevada operation remains strong.

But Gingrich fumbled some key opportunities.

A meeting in Carson City Wednesday with Gov. Brian Sandoval was scrapped following scheduling confusion between Gingrich's national and state staff. Sandoval had backed Texas Gov. Rick Perry, who endorsed Gingrich after exiting the race last month. Gingrich backers in the state had been hoping that even if Sandoval failed to offer up an endorsement, that a photo of the two men together would hold sway among conservative caucusgoers.

Gingrich insisted there was a scheduling conflict citing a grassroots rally at a brewery in Reno at 1 p.m. Wednesday. But Sandoval's staff said the meeting had been set to take place at 11 a.m.

Gingrich's Nevada director Dan Burdish said he was disappointed by the mix up.

"I would have loved to get the two of the together," he said.

The state team had also pushed for more campaign time, including a swing through rural parts of the state. They were rejected.

Without a debate to key in on, Gingrich ? who is usually seen as the wonkiest candidate in the room ? sometimes seemed downright out of the loop as he met voters.

News on Friday was dominated by new jobless numbers that suggested an economic rebound.

But Gingrich made no mention of them as he plowed through a speech at Stoney's Rockin Country, a music club in Las Vegas. Asked about them afterward by reporters he said he hadn't seen them yet.

Q: If my landlord is required by the city to obtain a business license in order to have rental properties, but chooses not to, is the lease agreement that I signed with her a legal and binding contract? It seems to me that if she is running an illegal business, she can't enter into contracts that bind her business. --Steven D.

A: The gist of your theory is that failing to get the legally required business license means she is running an illegal business, which means her business contracts are unenforceable. I don't think you would likely prevail with this argument.

A court will void a contract if it is illegal, or the parties were defrauded. Let's take the first possibility: An illegal contract is one:

  • with an illegal purpose (such as a contract for the purchase of cocaine)
  • in which the consideration, or payment, is illegal (for example, paying with stolen merchandise or funds); or
  • both, like an extortion agreement (obtaining money or property by threat to a victim's property or loved ones, intimidation, or false claim of a right, such as pretending to be an IRS agent).

A fraudulent contract is one in which an important term has been deliberately misrepresented or a party has been deliberately misled. For example, a landlord who rents a house for immediate occupancy, but fails to mention that the current tenants have refused to move and have forced the landlord to file for eviction, has seriously misled his would-be tenants. They could probably walk away from the lease without owing any money, no matter what the lease says or doesn't say about the landlord's obligations.

Your landlord's lease doesn't fit into any of these scenarios. There are other reasons for courts to invalidate contracts, however. If the contract violates public policy, particularly if it's a policy intended to protect one of the contracting parties, it won't be enforced. The best example of this is a usurious loan agreement (one that charges exorbitant interest). Your issue doesn't seem to fit into this category either.

Perhaps the better way to think about the validity of your lease is to consider why cities have imposed license requirements. For some cities, the requirement is purely a revenue-generating scheme, with licenses granted to every landlord who applies for one, regardless of the quality of that landlord's business practices or the suitability of the rental properties. Other ordinances couple the fee with oversight, requiring landlords to submit to inspections and attend classes on how to comply with landlord-tenant laws before they're granted the license.

Let's suppose that the licensing scheme in your city is of the first type, just a way to generate income for the city. Because the license isn't tied to protecting any tenant rights or encouraging good landlord behavior, a landlord's failure to get one is rather a non-event, as far as the tenant is concerned, and I doubt that a lease would be voided for this reason.

In other words, by failing to get the license, the landlord has simply violated a local ordinance. If she failed to file tax returns, a federal requirement, she'd also be a "lawbreaker," but that would not invalidate the leases she had created.

But if getting a license requires passing inspections and getting educated, sidestepping a licensing requirement might be significant as far as the tenant is concerned. Even if a landlord doesn't falsely represent that she's obtained a license, a tenant might be justified in assuming that she has done so. When the tenant learns that there's been no inspection, particularly if the property is substandard, the tenant might have grounds to not only complain about the conditions (he can always do that), but also to treat the contract as void.

Keep in mind that even if the lease is voided, a court would not allow "unjust enrichment." For example, a tenant would not normally be entitled to the return of rent already paid for time the tenant spent living in the rental.

Q: Our lease included a clause in which we agreed to a separation fee of two months' rent, after 60 days' notice, if we moved out early. We bought a house in October, gave notice (and paid rent) on Nov. 1, and moved on Nov. 15. The landlord re-rented the apartment almost immediately, with a new tenant set to move in on Jan. 10. While we're certainly prepared to pay rent through Jan. 10, we bristle at the thought that the landlord will be collecting double rent for the period of Jan. 10 to March 1 (when our separation fee runs out). Is this legal? --Alex H.

A: In most states, landlords are required to "mitigate damages" when tenants break a lease with no legal justification. This means that they must make reasonable efforts to re-rent the unit, and once they find a new tenant, the original tenant's responsibility for the balance of the rent ends.

The majority of these states have announced their rule in a statute, which may include a statement advising landlords and tenants that any attempt to contract away this duty will not be enforced by the courts. You can see why legislators would add this protection: It hardly does a tenant any good if a landlord can present the tenant with a lease that waives an important right the legislature sought to establish, especially because landlords are so often in the driver's seat when negotiating leases and rental agreements. The contract you signed requires that you pay four months' rent after giving notice, regardless of the landlord's success in finding a new tenant.

In some states, however, including New Jersey, Ohio and Utah, the mitigation rule is a common law rule: one that is contained in a court opinion, fashioned by judges after they have studied their state's historical treatment of the issue. These states are less likely to have a companion "you can't waive this" rule, because unless the question of waiver was part of the case, a court will usually not go out of its way to pass judgment on issues not before it. When courts reach the waiver issue, they may invalidate the waiver on the grounds that depriving a tenant of the benefit of the mitigation requirement is against public policy.

Let's assume for now that you're in the latter category: You've got the protection of the mitigation rule, but no clear legislative or judicial prohibition against waiving it. You may be in for some creative lawyering -- calling upon your state's consumer protection laws, for example -- to invalidate this contract. You might find some help in similar cases. You may learn, for example, that a court in your state has ruled that waiver is not allowable in a commercial leasing context.

By extension, the same rule ought to apply to residential leases, you'd argue. In fact, you can make a pretty strong case for extension, pointing out that residential tenants are likely to have less opportunity to negotiate their leases and get such a clause taken out. When parties to a contract (including a lease) have no meaningful way to negotiate its terms, the contract becomes one of "adhesion," which many courts are loath to enforce.

Stunning Photo Shows Growing Antarctic Ice Rift (LiveScience.com)

A massive crack in a huge sheet of Antarctic ice discovered in mid-October last year is steadily growing, as seen in recently released satellite images.

The fissure in the Pine Island Glacier ice shelf?marks the beginning stages of the birth of a 350-square-mile (900 square kilometers) iceberg, part of a natural process known as calving.

The image was snapped on Nov. 13, 2011, when the rift was roughly 19 miles (30 km) long, 260 feet (80 meters) wide for most of its length, and 195 feet (60 m) deep. When researchers first spotted the crack in mid-October, it was roughly 18 miles (28 km) long.

The ice shelf is the floating end of the Pine Island Glacier, a slow-moving river of ice in West Antarctica that moves ice from the interior of the continent out to sea.

The recent discovery that the glacier has markedly sped up over the last decade has provoked a flurry of research interest in Pine Island Glacier and its ice shelf, whose sudden changes are almost undoubtedly caused by climate change and warming oceans in the region.

However, the calving iceberg itself is the result of a cyclical process, not climate change, scientists say.

In fact, researchers had been expecting the ice shelf to produce a large iceberg sometime soon. The ice shelf last produced large icebergs in 2001 and 2007, and these calving events appear to happen on a roughly decade-long cycle.
